Muddying the Waters of the United States: Trump Administration Takes Aim at EPA Rule
WASHINGTON—Resources for the Future (RFF) Senior Fellow Alan Krupnick and Research Assistant Justine Huetteman posted a new blog on recent action by the Trump administration to rescind the controversial Obama-era rule known as the Waters of the United States (WOTUS) rulemaking. The rule extends Clean Water Act jurisdiction to small waterways and wetlands upstream of large water bodies. The new blog is entitled: Muddying the Waters of the United States: Trump Administration Takes Aim at EPA Rule.
The Trump administration argues that rescinding the rule would result in large net benefits to society. The authors examine the methodological choices made in the Trump EPA’s regulatory impact analysis of the rule that led to a 90 percent drop in benefits from the Obama EPA’s analysis of the rule.
The authors conclude: “The administration has a right to rescind a rule even if the cost savings from doing so are less than the foregone benefits—but no one is served by analyses that are not fully and fairly conducted.”
